Terms & Conditions

Workshop terms and conditions:

These Workshop Terms (Terms) govern your purchase of tickets for, and attendance at workshops held by Kimlligraphy (Workshops). It is your responsibility to review these Terms prior to the purchase of tickets. By purchasing tickets you agree to be bound by these Terms. We reserve the right to amend these Terms at any time, and will provide the most recent version on our website.

Throughout these Terms, the terms “Kimlligraphy”, “we”, “us” and “our” refer to Kimlligraphy and its associated entities, and “you” refers to the individual or business purchasing tickets or attending Workshops.

  • Workshop Booking and Ticket Purchase


1.1. A list of upcoming Workshops and ticket prices are available on our website and corresponding Shopify page.
1.2. In addition to the ticket, you must pay GST and any booking, handling, credit card surcharge or postage fees specified on our website and corresponding Shopify page.
1.3. Ticket prices are subject to change, and Kimlligraphy will use best endeavours to inform you if there is a change.
1.4. You may make a booking and/or purchase a ticket for a Workshop:
1.4.1. online via our corresponding Shopify page.
1.5. Your booking is confirmed when you receive an email notification (check your junk mail) and receipt from Kimlligraphy and/or Shopify. We will maintain a list of confirmed and paid up attendees for each Workshop, and you may gain entrance to the Workshop by presenting identification or your email receipt.

1.6. Our workshops are available for individuals ages 15 and over. All attendees including children are required to purchase a ticket. Children under 15 are strictly not permitted.

  • Refunds, Credits and Transfers


2.1. All ticket sales and table bookings are final. No exchange, credit or refund will be given except in the case of certain cancelled or rescheduled Workshops (see clause 3 below). For clarification, you are not entitled to a refund if:
2.1.1. you did not enjoy the workshop;
2.1.2. you are no longer able to attend the workshop; or
2.1.3. you arrive late or are refused entry for any reason.
2.2. A ticket is transferrable to another person on the following conditions:
2.2.1. a request is submitted in writing to support@kimlligraphy.com.au containing the replacement name and email address.
2.2.2. the request is submitted at least 48 hours prior to the workshop.
Kimlligraphy reserves the right to refuse entry if a replacement arrives at the workshop without the ticket being transferred via this procedure.

  • Workshop Cancellation or Postponement


3.1. Sometimes Workshops are cancelled, varied, rescheduled or postponed due to Force Majeure Workshops, situations which affect the trainer or other causes.

3.2 If a Workshop is postponed:
3.2.1 you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the postponed Workshop, obtain a credit for the ticket price to put towards another of our Workshops that occurs within 12 months of the originally scheduled date of the postponed Workshop; or
3.2.2 if you so elect, or if you fail to notify us in writing of your request for a credit within 30 days after the originally scheduled date of the postponed Workshop, your ticket will be automatically transferred to the new date for the postponed Workshop.
3.3. If a Workshop is cancelled and/or a new date for the Workshop is not announced within 60 days of the postponement/cancellation:
3.3.1  in circumstances where the Workshop is cancelled due to a Force Majeure Workshop, you will be given a credit for the ticket price to put towards another of our Workshops that occurs within 12 months of the originally scheduled date of the cancelled Workshop (no refunds will be issued);
3.3.2 in circumstances where the Workshop is cancelled for any reason other than a Force Majeure Workshop, you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the cancelled Workshop, obtain a refund of the ticket price (excluding booking, credit card and other fees).  If you so elect, or if you fail to notify us in writing of your request for a refund within 30 days after the originally scheduled date of the cancelled Workshop, you will be given a credit for the ticket price to put towards another of our Workshops that occurs within 12 months of the originally scheduled date of the cancelled Workshop.
3.3. We will use reasonable endeavours to notify ticket holders of a cancellation, variation, rescheduling or postponement of an Workshop by sending an email to the address provided to us by the ticket holder and putting a notice on our website; however the responsibility to ascertain whether a Workshop has been cancelled, varied, rescheduled or postponed is yours. We do not guarantee that ticket holders will be informed of a cancellation, variation, rescheduled or postponement before the date of the Workshop.
3.4 Except as expressly provided in this clause 3, in no circumstances will ticket prices (or any part thereof) be refunded or credited.  Any refund or credit issued will be your sole remedy for a postponement or cancellation of a Workshop, and we will have no further liability to you in respect of any cancellation, variation, rescheduling or postponement of a Workshop for any reason.  Any credits issued for postponed or cancelled Workshops that are not used within 12 months of the originally scheduled date of the postponed/cancelled Workshop will be forfeited.

4. Workshop Conduct


4.1. You are expected to behave in an appropriate manner at all Workshops. We reserve the right to refuse entry or require you to leave if your behaviour is deemed unacceptable.
4.2. You acknowledge that cameras, audio and video recorders may not be permitted at certain workshops. Kimlligraphy will advise whether this is the case at each workshop.
4.3. Kimlligraphy films and photographs every workshop. You consent to being filmed or photographed by Kimlligraphy (or its representatives) and to Kimlligraphy using your name, likeness, image and/or voice in such photographs or films for the purpose of promoting our workshops, services and products. No remuneration is payable for such use.

  • Limitation of Liability


5.1. To the extent permitted by law, we exclude all conditions and warranties relating to your purchase of tickets for and attendance at Workshops.
5.2. Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the face value of the ticket purchased by you, plus any relevant booking and delivery fees.

5.3  We will be excused from performance under these Terms and in relation to Workshops to the extent such performance is affected by a Force Majeure Workshop.

  • Miscellaneous

    6.1. These Terms shall in respects be governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises under these Terms.
    6.2. If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
    6.3. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
    6.4 In these Terms, a “Force Majeure Workshop” means any of the following (whether or not foreseeable or anticipated): acts of God, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic, government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other workshop, cause or circumstance that is beyond our reasonable control.
    6.5. These Terms constitute the entire agreement between Kimlligraphy and you in relation to the Workshops.

Movers and Breakers terms and conditions:


In these Terms of Sale, the following terms have the following meaning: Additional charges include all delivery, handling and storage charges; goods and services tax; stamp duty; interest; legal and other costs of recovery of unpaid money, and all other government imposts; and all money, other than the purchase price, payable by the customer to Kimlligraphy arising out of the sale of the goods or the provision of the services. Customer means the customer who purchases tickets for a Kimlligraphy workshop or who purchases goods or services. Ticket price means the price of ticket for the Kimlligraphy workshop. Purchase price means the list price for the goods as charged by Kimlligraphy at the date of delivery, or such other price as may be agreed by Kimlligraphy and the customer prior to delivery of the goods. Services means those services sold by Kimlligraphy to the customer, including tickets to workshops. Cancellation date means the date upon which a cancellation of ticket has occurred, subject to the timeframe it has been cancelled prior to the workshop. Scroll down for cancellation-date terms. GST means Goods and Services Tax. As a part of our quality procedures, it is important that Kimlligraphy and the customer agree on the terms on which business is to be transacted. These Terms of Sale are current for trading with Kimlligraphy at the time of issue, however the Terms of Sale may vary from time to time. SERVICES All bookings for a workshop run by Kimlligraphy must be in writing. A booking is accepted by Kimlligraphy once written notification is provided to you. An acceptance of a booking by Kimlligraphy is then to be an acceptance by Kimlligraphy and the customer of these Terms of Sale, to the exclusion of any terms and conditions imposed by the customer. No booking is binding on Kimlligraphy until it is accepted. Entry to any workshop may be refused if the customer has not paid for the workshop in full in advance.


VIDEO & PHOTOGRAPHY

The customer also acknowledges that Kimlligraphy films and photographs every workshop and that the customer consents to Kimlligraphy using name, likeness, image and/or voice in the workshop that they are photographed or filmed in any media for an unlimited period without remuneration for the purpose of promoting any service and/or products supplied, and/or distributed, by Kimlligraphy.

GUEST SPEAKERS & CO-TRAINERS

Views expressed by guest speakers or co-trainers are their own. Kimlligraphy cannot accept liability for advice given, or views expressed, by any guest trainer or co-trainer at the workshop or in any material provided to delegates.

IMITATION OF LIABILITY

Certain laws imply terms, conditions and warranties (prescribed terms) into contracts for the supply of goods and services and prohibit the exclusion, restriction or modification of such term, conditions and warranties. The liability of Kimlligraphy in respect of a breach of a prescribed term or any warranty made under these terms of sale is limited, to the extent permissible by law and at the option of Kimlligraphy to:

  • In the case of services, the supply of the services again; or the payment of the cost of having the services supplied again; and
    • In the case of goods, the replacement of goods or the supply of equivalent goods; the repair of goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired.

Unless the terms and warranties are included in these Terms of Sale, all prior discussions, quotations, warranties and Prescribed Terms, to the extent permitted by law, are excluded and Kimlligraphy will not be liable for any loss or damage or for consequential loss or damage of any kind arising out of the supply or failure to supply of goods or services, or arising out of Kimlligraphy’s negligence or in any way whatsoever.

MISCELLANEOUS

These Terms of Sale are to be construed in accordance with the laws from time to time in the state of New South Wales, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales. These Terms of Sale contain all of the terms and conditions of the contract between the parties and may only be varied by agreement in writing between the parties. Any conditions found to be void, unenforceable or illegal may, to that extent, be severed from the agreement. No waiver of any of these Terms of Sale or failure to exercise a right or remedy by Kimlligraphy will be considered to imply or constitute a further waiver by Kimlligraphy of the same or any other term, condition, right or remedy.
