Your access to and use of this website, as well as all related websites operated by Kimlligraphy (including kimlligraphy.au, among others) (collectively the “Site”), is subject to these Terms of Use and all applicable laws. By accessing or browsing the Site, you accept, without limitation or qualification, these Terms of Use, which supersede any prior agreements.

1. Use of Site Content

1.1. The Site, including all content, videos, training materials, products, services, and other materials (collectively, “Content”) are maintained by Kimlligraphy (“Company”) and/or its third-party providers. Content includes proprietary videos, code, graphics, sound recordings, artwork, photos, documents, and text.

1.2. Content is provided for your personal use and information only. You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and view the Site and Content for personal purposes only.

1.3. You may not copy, reproduce, republish, upload, post, transmit, distribute, or use the Content for public or commercial purposes without prior written permission from Kimlligraphy. Modification or unauthorised use of Content violates copyright and may result in legal penalties.

11. Use of Third-Party Platforms, Content Handling, and Sensitive Information

11.1. Kimlligraphy may use third-party platforms and software, including but not limited to WeTransfer, CapCut, and similar services (“Third-Party Platforms”), for file transfer, editing, and content processing.

11.2. Clients retain ownership and copyright of all original content provided. However, by uploading or sharing content via Third-Party Platforms, clients grant licenses and usage rights to those platforms as per their terms, which may include rights to use, reproduce, distribute, or display the content.

11.3. Clients must disclose in writing if any content is sensitive, confidential, or intended for internal use only. Upon such notice, Kimlligraphy will avoid using Third-Party Platforms with broad content licenses or exposure risks and will use alternative secure tools instead (e.g., Adobe Premiere Pro).

11.4. If clients do not disclose content sensitivity, Kimlligraphy will assume consent to use standard Third-Party Platforms under their terms.

11.5. Clients acknowledge Kimlligraphy does not control Third-Party Platforms’ terms or privacy policies and cannot guarantee protection against unauthorised use or public exposure of content.

11.6. Kimlligraphy is not liable for loss, damage, or unauthorised use of content resulting from use of Third-Party Platforms.

11.7. Clients agree to indemnify Kimlligraphy for claims arising from failure to disclose content sensitivity or unauthorised content use via Third-Party Platforms.

12. Australian Consumer Law

12.1. Nothing in these Terms limits or excludes consumer guarantees or statutory rights under Australian Consumer Law or other legislation that cannot be excluded by law.
